Terms and Conditions
These Terms & Conditions (“Terms”) govern (a) accommodation bookings made for Vogelsang Boerdery, (b) farm activities and experiences booked with Vogelsang Boerdery, (c) purchases of seasonal produce and farm products, (d) enrolment in Vogelsang Boerdery leadership courses (“the Boys & Girls Course” and any related programmes), and (e) purchases of books, manuals, and related materials, whether made via our website, telephone, WhatsApp, or in person. By submitting a booking request, enrolling in a course, or placing an order, you (“the Guest”, “the Participant”, or “the Customer”) agree to be bound by these Terms.
1. Definitions
- “Company”, “we”, “us”, “our” means Vogelsang Boerdery.
- “Guest” means any person who requests or holds a booking for accommodation at Vogelsang Boerdery.
- “Participant” means any person enrolled, or enrolling a minor, in a Vogelsang Boerdery leadership course or farm activity.
- “Customer” means any person who purchases produce, farm products, books, or manuals from Vogelsang Boerdery, whether or not they are also a Guest or Participant.
- “Booking Request” means a request for specific dates and a cottage submitted via our website or other channel, which becomes a confirmed booking only once approved and paid in full.
- “Farm Activities” means guided or hosted experiences presented on the farm by Theo, including but not limited to farm tours, animal husbandry demonstrations, and outdoor activities.
- “Courses” means the online and practical leadership courses offered by Vogelsang Boerdery, including the Boys Course and Girls Course, presented in conjunction with farm activities.
- “Publications” means motivational, parenting, or related books and manuals authored by Denielle and sold through Vogelsang Boerdery.
- “Website” means our official Vogelsang Boerdery booking and shop platform and any successor domains we operate.
2. Accommodation Bookings
2.1 Making a Booking — Request and Approval
Vogelsang Boerdery stays in control of every booking across our four cottages. Booking requests are not confirmed reservations. The process is:
- You submit a booking request via our website or by contacting us directly, specifying the cottage, dates, and number of guests (adults and children).
- Our booking calendar for each of the four cottages is managed and kept in sync with our master availability, including any bookings still received via third-party platforms during our transition to direct bookings.
- If approved, you will receive a secure payment link or invoice by email or WhatsApp.
- Your booking is confirmed once full payment (or an agreed deposit, per clause 2.3) is received.
- You will receive a booking confirmation with your booking details and arrival information.
We reserve the right to decline a booking request. No booking exists unless and until a request has been approved and paid for as required.
2.2 Availability
We are moving our primary accommodation calendar in-house, with the aim of each of our four cottages having a single, accurate calendar rather than relying on third-party platforms. Where a booking is still accepted through a third-party platform during this transition, we make reasonable efforts to keep all calendars aligned. In the rare event that a technical delay results in a request for dates that are no longer available, we will contact you immediately to offer alternative dates or a full refund.
2.3 Rates and Payment
Rates are quoted in South African Rand and are inclusive of VAT where applicable. Once your booking request is approved, payment is required via our secure payment link (card, Instant EFT, or QR code, where available) to confirm your stay. If a deposit option is offered for your booking, this will be stated at the time of approval; otherwise full payment is required up front. If you pay by Instant EFT, please allow up to 48 hours for your payment to be confirmed and your booking finalised, as EFT payments are verified manually by our team.
If you book through a third-party platform such as Airbnb or Booking.com, that platform takes payment on our behalf under its own payment and cancellation terms, and those terms will apply to your booking in addition to the house rules in this document. Please bring means to cover any extras payable directly at the farm.
2.4 Returning Guest Loyalty Discount
Returning guests who book directly with Vogelsang Boerdery may qualify for a loyalty discount on accommodation. Details of any current loyalty offer will be confirmed at the time of booking.
2.5 Cancellations and Refunds
If you need to cancel a confirmed booking, the following refund tiers apply:
- More than 1 month before check-in: 100% refunded.
- More than 2 weeks before check-in: 50% refunded.
- Less than 2 weeks before check-in: no refund.
Approved refunds are processed to your original payment method. Date changes are subject to availability and may be treated as a new booking request depending on how close to arrival the change is requested.
2.6 Check-In and Check-Out
Check-in is from 10:00 to 19:00. Guests must let us know their expected arrival time in advance so that self check-in can be arranged. Cottages use self check-in via a lockbox; access details are sent ahead of arrival. Check-out is before 10:00.
- Please gather and leave used towels as directed in the cottage.
- Please put all trash in the bins provided before departure.
- Please switch off lights, appliances, and geysers/heaters before checking out.
- Please return any issued keys and lock up the cottage on departure.
Full guidance for your specific cottage is provided in the owner’s manual left in the cottage — please read this on arrival.
2.7 Age Restrictions and Children
- The minimum age for the primary guest checking in is 18. A booking cannot be made or checked in on behalf of a group of guests all under 18.
- Children older than 9 years are welcome when accompanied by an adult on the booking; children under 9 should be discussed with us in advance given the working-farm environment.
- Guests aged 18 and above are charged as adults. Please state the number and ages of all children in your party at the time of booking so we can confirm suitability and pricing.
- Cots and extra beds are not available at our cottages.
2.8 Guest Conduct and House Rules
You’ll be staying in a home on a working farm, so please treat it, its contents, and the surrounding property with care and respect. The following rules apply to all stays:
- The number of guests per cottage (adults, children, and infants) must match what was confirmed at the time of booking.
- No pets are allowed at any cottage.
- No parties or events.
- No commercial photography or filming without our prior written consent.
- No smoking inside any cottage.
- Braai (BBQ) fires must be fully extinguished and supervised at all times; open veld fires are strictly prohibited given the fire risk on and around the farm.
- Guests are asked to be considerate of other guests with regard to noise, particularly after 22:00.
The Company reserves the right to refuse accommodation or request a Guest to vacate the premises, without refund, in cases of serious misconduct, damage, or breach of these rules.
2.9 Liability for Damage
Guests are responsible for any damage caused to the cottage, its contents, or other farm property beyond fair wear and tear during their stay. Guests may be charged up to ZAR 1,000 after check-out to cover the cost of repair or replacement, and a higher amount where actual costs exceed this, in accordance with our damage policy.
2.10 Force Majeure
Neither party will be liable for failure to perform an obligation under these Terms where this is due to circumstances beyond reasonable control, including but not limited to extreme weather, load shedding, fire, flood, road closures, or other acts of God. Where we cannot honour a confirmed booking due to such an event, we will offer an alternative date or a full refund.
3. Farm Activities
3.1 Booking Farm Activities
Farm activities presented by Theo — including farm tours, demonstrations, and other hosted experiences — may be booked as a stand-alone activity or as an add-on to an accommodation booking. Activities are subject to availability, weather conditions, and minimum numbers, and may be rescheduled or cancelled by us where safety or operational conditions require it, in which case a full refund or alternative date will be offered.
3.2 Participant Safety
Farm activities take place in a genuine working farm environment. Participants take part at their own risk and must follow the guidance of Theo or any other host at all times. Parents or guardians are responsible for supervising minors during farm activities unless the activity is specifically structured and staffed for unsupervised participation.
4. Seasonal Produce and Farm Products
4.1 Product Availability
Seasonal produce and farm products are offered subject to availability and harvest or production cycles, and may vary from what is shown on our website at any given time. Where a product ordered is no longer available, we will contact you to offer a substitute, refund, or delayed fulfilment, as appropriate.
4.2 Orders, Payment, and Collection
An order is confirmed once payment has been successfully processed and you have received an order confirmation. Depending on the product, fulfilment may be by collection at the farm, courier delivery, or collection aligned to an accommodation booking arrival or departure. Perishable and fresh items are collection-only unless otherwise stated, for freshness and food-safety reasons.
4.3 Risk and Ownership
Ownership and risk in produce and farm products pass to the Customer on collection or on handover to a courier at the recorded delivery address. We recommend checking perishable items on collection or immediately on delivery.
5. Leadership Courses (Boys Course & Girls Course)
5.1 Enrolment
Enrolment in an online or practical leadership course is confirmed once payment has been received and you have received an enrolment confirmation. Practical, farm-based sessions are subject to availability, minimum and maximum participant numbers, and applicable age ranges, which will be stated for each course.
5.2 Parental Consent and Supervision
Where a Participant is a minor, a parent or legal guardian must complete the enrolment and consent to participation, including any physical or farm-based activities that form part of the course. Parents or guardians remain responsible for their child’s general wellbeing and must disclose any relevant medical conditions, allergies, or special needs prior to a practical session.
5.3 Access to Online Course Content
Online course content is provided for the personal use of the enrolled Participant (or their parent/guardian, where the Participant is a minor) and may not be copied, shared, resold, or redistributed. We may revoke access where these Terms are breached.
5.4 Cancellations and Rescheduling
Cancellation and refund terms for a specific course intake will be confirmed at the time of enrolment. Where we cancel or reschedule a practical session — for example due to weather or insufficient numbers — we will offer an alternative date or a full refund.
6. Books, Manuals, and Publications
6.1 Orders and Delivery
Publications authored by Denielle, including motivational and parenting books and manuals, may be purchased in physical or digital format, as offered. Physical copies are fulfilled by courier delivery or collection at the farm; digital copies are made available for download or access once payment is confirmed.
6.2 Digital Content Licence
Where a Publication is supplied in digital format, the Customer receives a personal, non-transferable licence to use the content and may not reproduce, resell, or distribute it without our written permission.
7. General Terms
7.1 Intellectual Property
All content on our website and marketing materials, including text, photographs, logos, course materials, and Publications, is the property of Vogelsang Boerdery or its licensors (including Theo and Denielle, as applicable) and may not be reproduced without written permission.
7.2 Limitation of Liability
To the fullest extent permitted by South African law, the Company will not be liable for any indirect, incidental, or consequential loss arising from use of our website, a booking, a farm activity, a course, or a product purchase. Nothing in these Terms limits any right or protection you have under the Consumer Protection Act 68 of 2008 that cannot lawfully be excluded.
7.3 Indemnity
Guests, Participants, and Customers use the accommodation, farm, activities, and facilities at their own risk. You agree to indemnify the Company against any claim arising from your own negligence, or that of persons in your party or under your care, save where caused by the Company’s gross negligence.
7.4 Governing Law and Jurisdiction
These Terms are governed by the laws of South Africa. The parties submit to the non-exclusive jurisdiction of the South African courts having jurisdiction over the area in which the farm is situated.
7.5 Changes to These Terms
We may update these Terms from time to time. The version in force at the time of your booking request, enrolment, or order will apply. The “Last updated” date at the top of this document reflects the most recent revision.
